Confederate Flags will lead you to the Missouri Capital
The Colonel John T. Coffee Camp #1934, SCV, of Stockton, Missouri is taking some advice from the Project Wave of Georgia and Mr. Clint Lacy’s drive to put flags across Missouri.
Stockton, Missouri is located in the Western part of Missouri. Of course you know that in this part of the country there was a war going on long before The War of Northern Aggression. It was the Kansas Missouri border wars, and was the precursor of the Northern Aggression War.
The Federal government laid waste to the Western part of Missouri. They burnt every house, barn, and many communities because they were Southern. This has been called the "Burnt District". Many communities still have not recovered from that time.
Members of the Camp have assessed the situation and felt it appropriate to help guide travelers through Missouri. What better way than to start where the war actually started in the 1850’s. Our goal is to get permission from landowners along US Highway 54 and then place flags.
The first flag we want to place is the Confederate Battle Flag at the Kansas and Missouri border. This is very appropriate because just inside the Kansas line is Fort Scott. Our goal is to place a flag every 20 miles. This will bring us to Nevada, Missouri, "The Bushwhacker Capital". We will continue on until we reach Jefferson City, Missouri, the State Capital.
Once in the Capital City we hope to get permission from individuals to place a Confederate Battle Flag as close to the Capital as possible, so the State Officials will see it fly every day and night.
We will be putting all Confederate flags up along the way and even the "Black Flag" to represent one of our leaders, Col. Quantrell.
After the Highway 54 project is completed, we hope to guide travelers along another major road across Missouri.
If you would like to help us make this effort a reality, you can contact the Col. John T. Coffee Camp Commander Gary Ayres at 3615 S. 70th Rd, Humansville, MO 65674. We are looking to do this project for just under $50.00 per flag and pole.
Thank you for your support,
Gary AyresI've got some great news. I am commissioned Lt. of the Confederate States Allied Europe, an
organization that searches for confederate and yankee soldiers (mostly sailors, remember the CSS Alabama !!) who are buried in Europe.
We are organized in Russia, England, France and in Belgium.
After a few days of correspondence with the Commander of Belgium I was admitted as Lt. in their
organization. My commander is a member of the SCV Alabama

THE SOUTHERN-PATRIOT MOVEMENT: POLITICS, OR PROTEST DEMONSTRATIONS?
Now that liberalism's attacks against the South's heritage and culture have reached crisis proportions, should we dig in our heels and fight; or turn
to the politicians for our salvation; or retreat slowly before the
onslaught; or fold our tents now and disappear swiftly into the night?
by Frank Conner
The continuing Georgia flag-fight has triggered an entire spectrum of
reactions from leaders of the Southern-patriot movement, and the regional pundits who discuss that movement in print. Some of them recommend that the
Georgians fight to reinstate the 1956 state flag with its battle-flag element--which Governor Perdue and the Georgia General Assembly, working in
concert, recently managed to bury officially. Other leaders/pundits recommend that we become full-time backers of the Republican party in
Georgia, in hopes that over time we will become such an important element of the party that someday we can then persuade it to reinstate the 1956
flag. Others want us to ignore the Democrats and Republicans and sponsor a third political party.
Still other leaders/pundits of the Southern-patriot movement recommend that we embrace the modified First National flag which Georgia's state
government has arbitrarily foisted upon us, and declare it a great victory for our cause because that flag has a vaguely-Confederate theme. Others
recommend that we abandon the field entirely, because the people of Georgia have so far failed to rally around us and carry us to victory. And still
other leaders/pundits have maintained an unbroken silence regarding the Georgia flag-fight.
That flag fight is an excellent litmus-test, because the attitudes of the
leaders and pundits toward it largely reflect their attitudes toward the
entire Southern-patriot movement. So who among them is right? Whose views should the Georgians (and the rest of the traditional Southerners) accept?
Whom should we now follow? At this point it is very difficult to decide those questions, because few if any of those leaders and pundits have put
their views re the Georgia flag-fight in the proper context: many of them have failed to state clearly their long-term goals for the Southern-patriot
movement; and most have failed to describe the battlefield conditions of the current era which necessarily shape the strategy and tactics of the
ongoing culture-war. So unless we can also learn the views of the leaders and pundits on those two key elements, then their comments about the
Georgia flag fight are largely meaningless.
THE LONG-TERM GOALS OF THE SOUTHERN-PATRIOT MOVEMENT
Of the goals stated by the various Southern-patriot organizations, I like
best the ones contained in Gen. Stephen Dill Lee's charge to the SCV, as follows: "To you, Sons of Confederate Veterans, we submit the vindication
of the Cause for which we fought; to your strength will be given the defense of the Confederate soldier's good name, the guardianship of his
history, the emulation of his virtues, the perpetuation of those principles he loved and which made him glorious and which you also cherish. Remember,
it is your duty to see that the true history of the South is presented to future generations."
In other words: cherish your Confederate heritage (which consists primarily of the belief system and way of life of the Old South--minus slavery and
segregation); live by it; and persuade your fellow Southerners to live by it too. In practice, this means living by the following set of priorities:
religion (usually Christianity) first; then personal honor--including
seamless honesty and unrelenting courage in the face of whatever comes along; then family; then community; then fairness in dealing with all
others; and then kindness to others, whenever they will permit that. This belief system also demands a sharply-limited federal government as
prescribed by the US Constitution; and it holds the firm conviction that the state exists to serve the citizen--and not the other way around as the
liberals insist. S.D. Lee also charges us to convince our fellow Southerners--by example and persuasion--to live this same kind of life. And
he asks us to defend our Confederate heritage effectively against all attacks mounted by our enemies (who are primarily the ideological liberals
and their black-activist catspaws).
If those are your goals for the Southern-patriot movement too, then the
need is clear and unambiguous. If you care anything at all about the kind of South that your children and grandchildren will inherit, then you must
not surrender; you must not pretend that our resounding defeats are actually our victories, or that they do not matter; you must treat all of
the current politicians as the adversaries that they really are and will remain until such time as we have converted so many Southerners to our side
that we can at will turn any Southern politician out of office; and you must fight effectively to discredit and defeat our enemies, and regain what
we have lost. If you do not, the liberals will finish converting the South into their "New South" Gramsci-Marxist paradise with government-enforced
social and economic equality for all--except that in actual practice the traditional whites won't be anywhere near as equal as the liberals and the
black activists.
Because ideological liberalism has been employed as official US-government policy for the past 40 years, and the general public has observed that it
is unworkable, liberalism has at last become vulnerable, such that our movement could now counterattack it ideologically (with words, not
bullets); discredit in the eyes of the Southern public the beliefs and policies of the liberals who now control all of our institutions; and
persuade that public to readopt the belief system and the way of life of the traditional South. By so doing, the South could regain its rightful
place in the sun. (For details of that approach, read my book, "The South Under Siege 1830 - 2000 /A History of the Relations Between the North and
the South.")
Thus, our leaders and pundits who urge us to surrender openly, or to
surrender covertly by rejoicing in the fact that our enemies have not yet
quite finished taking away all of our Confederate symbols, or to retreat
discreetly so as to avoid putting our dignity at risk, or to put our faith
in the politicians now when we have no control over them, cannot possibly be pursuing admirable long-term goals for
the Southern-patriot movement. Therefore they should step aside.
THE TRUE NATURE OF OUR BATTLEFIELD TODAY
In recent years, many longtime defenders of Southern heritage have failed to take stock of the basic changes in the nature of the culture war being
waged against us--thus in the conditions which exist on the battlefield today. What they have failed to notice is that several years ago, to all
intents and purposes our enemies (the liberals, with recent assistance from the black activists) won the ideological war which they've been waging
against the traditional white Southerners for more than a century and a half--to destroy us as a people; and now they're just mopping up.
In Georgia, for example, our deadly liberal enemies now control virtually all of the news-and-entertainment media; the education establishment; big
business; most of the regional and local governments; most of the judiciary; and virtually all of the other major institutions. The liberals
and their black-activist catspaws can and do regularly call our Confederate ancestors and ourselves any filthy name in public; they can and do
regularly tell any base lie that comes to their minds about our history in the newspapers, on television, and in the movies; and they refuse us access
to their media to rebut their calumnies and lies. Accordingly, they have successfully blackened the names of our Confederate ancestors, and they
have made our heritage and culture synonymous with evil in the minds of much of the public. The liberals have now had 40 years in which to
brainwash and guilt-trip the people of Georgia into repudiating the belief system of the Old South; and they have made the most of their opportunity.
Consequently, the people in the Southern-patriot movement are no longer members-in-good-standing of the establishment, defending our homeland
against the invading armies of liberal ideologues. Our homeland no longer exists, except in our memories; we ourselves are now living and operating
in hostile territory; and in the eyes of our institutions, we are now second-class citizens who no longer deserve the rights and privileges that
are now reserved for the politically-correct "good" citizens. Thus, the sociopolitical environment which we presently encounter in Georgia and most
of the other Southern states is really no different from that of, say, Ohio or Illinois.
Our enemies have successfully discredited the belief system of the
traditional South in the eyes of the public; and they have persuaded the public that the traditional Southerners do not deserve to be allowed to
exist as a people; and without those basics, we have nothing of importance left of our heritage and culture to defend. All we have left are a few
remaining Confederate symbols which our enemies are now systematically taking away from us. We have been vanquished, and destroyed as a people.
So we can no longer think of fighting a defensive war. If we wish to
accomplish anything of value, we must now think in terms of taking back that which has been taken away from us: our self respect, our faith in the
validity of the belief system of the Old South, and our legitimacy as a people. And then we must discredit our mortal enemy--liberalism--in the
eyes of the Southern public. And then we must cause the rest of the Southerners to readopt the belief system of the Old South, and regain their
status as a people to be respected.
For all practical purposes, the people in the Southern-patriot movement are now revolutionaries, not defenders. It is vitally important that we
recognize this major change to our status, and change our mindsets accordingly. People with a defender's mindset cannot lead a revolution or
participate in it effectively; they can only impede it. (In addition, those who joined the Southern-patriot movement only because they wanted to bask
in the reflected glory of their Confederate ancestry would do well to depart the movement now. And those who--unlike their Confederate
ancestors--only wish to participate if their side is in the majority will also find this a convenient time to depart the scene.)
I have been speaking in terms of doom and gloom, but potentially our future is bright--if we will acknowledge the realities and take full advantage of
them, because although our enemies now wield all of the power, they have become dangerously vulnerable. And we do have many natural allies in
Georgia and the rest of the South: they are the traditionalists who live in the small towns and have not been brainwashed and guilt-tripped as
effectively as the "New South" residents (the chattering classes) of the big cities. Once we have gotten our own act together, we will need to
romance these people and turn them against the liberals in the big cities who are changing the South into a tightly-regulated socialist regime, and
the politicians who support those liberals. By polarizing the South in that way, we can soon become a powerful force--if we do not fall into such
politicians' traps as "inclusiveness" and "the big tent."
So. Those people in the Southern-patriot movement--including some of its leaders and its pundits--who think they are still living in the South of 20
or 30 years ago, and who are acting accordingly, are crippling the
effectiveness of the movement. We need to acknowledge that our enemies have won their war against us, and learn how to counterattack them most
effectively, and ignore those leaders/pundits who continue to preach business-as-usual.
THE GEORGIA FLAG-FIGHT AS METAPHOR FOR THE SOUTHERN-PATRIOT MOVEMENT
For many decades, the smartest revolutionary in Georgia has been a black activist named Tyrone Brooks, who serves as a state representative
(D-Atlanta), and generally runs the black political-caucus in Georgia. Early on he learned to play the intricacies of the Civil Rights Act of 1964
and the Voting Rights Act of 1965 like concert-grand pianos; and single-handedly he tied the voting procedures and the state judiciary of
Georgia into a series of racial Gordian-knots, and just about brought the state to a standstill.
Brooks is the dedicated enemy of the traditional white Southerners. And ten or fifteen years before the NAACP figured it out, Brooks realized that the
battle flag is the keystone symbol of our entire Confederate heritage. Yank it out, and the rest of the entire structure will inevitably crumble and
come tumbling down. But Brooks knew that the Georgians would not stand for the summary expulsion of the 1956 flag. It would have to be a two-step
process, in which the Georgians would first have to be threatened and cajoled into substituting something like the First National flag of the
Confederacy for the battle flag; and then four or five years later the black activists could successfully demand that the First National flag be
taken down. So for 22 years Brooks introduced bills into the Georgia General Assembly to substitute a modification of the First National flag
for the 1956 flag with the battle flag emblem. His bill failed each time.
Finally, in 2001 the black activists (backed fully by the liberal CEOs of
big business in Georgia) found an accommodating governor--Democrat Roy Barnes. He then cut such a huge number of backroom deals with members of
the General Assembly that he was able to call for a surprise vote by the legislature to junk the 1956 flag and replace it with a totally-different
design (not even a recognizable Confederate flag per se). The public got only three or four hours' forewarning that any such measure was even being
contemplated, and was shocked by the underhandedness of that coup. It rubbed the Georgians' noses in the smelly fact that Georgia's politicians
notoriously run the state so as to suit big business and the black
activists, not the citizenry. A number of Southern patriots (mostly SCV
members, but also including members of the League of the South, the
Southern Party of Georgia, and others) independently began to mount protest demonstrations
("flaggings") during the reelection campaigning of Barnes and his cohorts; this attracted widespread attention, and eventually the
uniformly-hostile news media were forced to cover the flaggings. Most political experts believed that the flaggings were a major factor in
Barnes' failure to get reelected.
Previously, the out-of-power Georgia Republicans had used the battle flag as a handy wedge-issue to help unseat the reigning Democrats; but when
Republican candidate Sonny Perdue won the governor's race, and the Republicans captured the Senate, the shoe was then on the other foot. The
Republicans too take their marching orders from the liberal CEOs of big business in Georgia and the black activists; so now they too wanted no part
of the 1956 flag. Earlier Perdue had promised the citizens a referendum so they could select their state flag, but instead of giving them a straight
choice between the hated 2001 flag and the 1956 flag that it had replaced, Perdue offered them a convoluted multi-step procedure which also contained
the pre-1956 First National flag; clearly he intended for the 1956 flag to
lose. The General Assembly got the message and modified Perdue's plan, to eliminate the 1956 flag from the referendum, and arbitrarily adopt
immediately a modified version of the First National flag; and Perdue signed that travesty into law.
The flaggers now understand clearly that they have nothing to gain by
attempting to ally themselves with either of the political parties in
Georgia, because both parties are politically correct and want nothing to do with the traditional Southerners--except to get their votes on election
day. The flaggers understand that the only way they can get back their 1956 flag and their Confederate heritage which goes with it is by causing the
politicians to fear them more than they now fear big business and the black activists. The flaggers know that they can best attain that goal by
mounting protest demonstrations at every public appearance by the governor and the other key players who torpedoed our 1956 flag, to persuade the
public not to reelect them in 2004.
Reinstating the battle flag as an element of the Georgia state flag is
vitally important, because it has been proven time and again that the
battle flag is the only symbol beneath which the Southerners will rally in defense of their heritage and their culture. But the key factor here is not
how fast we get it reinstated, but how we go about that: how we fight is far more important than when we win; the process is actually more important
than the end result.
The liberals own the news media, and one of their most-important weapons for destroying the traditional Southerners as a people has been to slant
everything they say about us to denigrate us, and then to prevent us from gaining access to the media to put across our own story. That has been
liberalism's giant roadblock, which has traditionally prevented our movement from getting off the ground. But the Georgia flaggers broke that
roadblock, with their shocking-but-colorful tactics and their persistence.
After awhile they became such big news that the hostile media could no longer ignore them, and had to give them big coverage. And the public was
impressed by the activist flaggers--in ways that it is not impressed by
Southern patriots conducting ceremonial events. These flaggers obviously were men who cared enough about their heritage to fight for it--in some
cases with their wives and children standing by their sides. And they obviously cared more about saving the South than about preserving their
dignity.
Such was the nature of the drama building around the Georgia flaggers' protest-demonstrations in 2002 that had the election not come about when it
did, soon the news media would have been forced to give the spokesmen of the flaggers a mass-media soap-box from which to tell the now-attentive
Georgia public in detail about their Confederate heritage and what is being done to it. That is the kind of opportunity which the Southern-patriot
movement has only dreamed of until now.
The other vitally-important point about the flaggings is that they taught
the flaggers some invaluable lessons about themselves which could not be learned in any other way. Society's awesomely-effective conditioning
dictates that each well-brought-up Southerner must remain meek, mild, obedient, and polite at all times; must avoid public confrontations at all
costs; and must be concerned about maintaining his dignity above all else. People with the standard Southern-mindset are not mentally equipped to
fight off liberalism's all-out attacks against us; yet that is the mindset which most members of the Southern-patriot movement have; and that is why
we have made so little progress. Yet in the case of the Georgia flaggers, their repeated direct confrontations with the establishment on the street
broke their conditioning and changed their mindset. This had some startling results.
The flagger came to realize that while he was flagging, he was no longer bound by society's ordinarily-restrictive behavioral demands. Therefore the
flagger no longer saw himself as society's captive, helpless to withstand its manipulations; instead, he was now a free agent, and society was
vulnerable to HIS manipulations. He realized that he did not need a Big Daddy to tell him what to do at every step along the way. He was free to do
almost anything he could think up; there was precious little that he could not get away with; and so he began to think outside the box. The flagger
stopped fearing for his dignity; he realized that his dignity no longer mattered, because others now saw him as a powerful agent of change--for
good or ill, depending upon their own viewpoints.
The flaggers now realized that numbers of people alone are meaningless; it is the dedication and ingenuity and determination of the participants--many
or few--that count for everything. Our fight with our enemy is really only a contest of wills; the side that is most determined wins, regardless of
its size initially. So the flagger is really a revolutionary. And ten revolutionaries can accomplish more than a thousand ordinary brainwashed
citizens.
Participation in only one or a few flaggings or other direct confrontations won't change your mindset. Neither will marching in a thousand parades or
participation in a thousand rallies; you have to confront your enemy directly and personally on his turf; and you have to do that
repeatedly--and that makes you a free man.
Given our enemies' vast resources and total dedication to the destruction of our heritage and ourselves as a people; and given our own lack of
resources, and the present lukewarm determination of most members of the Southern-patriot movement to defend our heritage and our people; then
widespread activism of the type that I have described here is probably our only realistic path to victory. But significantly, there is probably not a
single high-level leader within the Southern-patriot movement who has taken that path and become radicalized himself; thus, there is not a single
leader within our movement who could attract and hold the allegiance of the
flaggers and other real activists.
Our traditional weapons--angry letters to the editor, rallies, boycotts,
etc.--have all failed completely to slow even momentarily the onslaught of our enemies. If we want to win out in the hostile environment which now
constitutes the South, we will have to embrace lawful-but-in-your-face activism on a large scale, and be ready to put across our real message
powerfully to the public when the opportunities inevitably arise as the result of that. That is the only way we can attract and hold everyone's
attention, put the fear into the politicians and our other enemies, and start converting the Southern public back to reality and sanity in their
daily lives.
The Georgia flaggers have already begun flagging Governor Perdue for
burying our flag last month. So it will not stay buried.

From the Atlanta Constitution on the Georgia
Flag: this may be a dumb question, but why do you sound so consistently hostile
to the legitimate feelings of people who find the confederate emblem offensive? if the confederacy had defended the enslavement of your
ancestors, how would you feel about that? -- colin campbell.
Colin,
Those lazy people should strive to learn about the history of the country they love.
Then they would know that it was their people that either killed or captured, enslaved, and sold them
to the Yankees. They would learn that the Yankees later found them unsuitable and unprofitable
for their factories, and sold them to Plantation owners (Yankees included) in the Southern
states. They would learn that no one was placed into slavery by the Southern States.
They would learn that Lincoln's War was about tariffs, that only 6% of the Southern defenders
actually owned a slave. That the Confederate constitution was the one that forbade the importation of slaves. That the flag they have been taught to hate was never a Government
flag and it never flew over slavery. It was the flag of the soldiers which included Blacks,
Hispanics, Jews, Native Americans, and many other groups.
Therefore, my feelings are not for those too lazy to study. My feelings are for my Grandfathers
who gave their all for their families, their homes, and their State of Georgia when invaded by
Lincoln's paid invaders: murderers, looters, rapists, and arsonists. We Southerners will always
honor our brave ancestors and the flags they fought under, so either go home or get used
to us following the fifth commandment of God's law.
P.S. It was the USA flag that defended slavery for 89 years. When do you suggest
we trash it? And do the Native Americans have feelings? Why would you not be as concerned
about their feelings?

What We Have Learned From the Lott Affair
(December 12, 2002)
It would have been much easier to have believed that all of the denunciations of Trent Lott were being spewed from the old Soviet Union’s entrenched communists than to have to come to grips with the fact that this is the dangerous climate now existing in the United States. Not only do we have Democrats, hoping they can flush Republican integrity down the drain - which paltry amount would not put a strain on the sewer pipes - but we also have Republicans in toto trouncing Senator Lott as roundly as the Democrats. (No wonder Samuel Francis calls them the Stupid Party.) Add to that the subversive media, which is virtually a carbon copy of Pravda, the official newspaper of the old Soviet Union, and you realize that we here have become what the Soviets once were.
What Trent Lott said was true. If the country had elected Strom Thurmond in 1948, we "wouldn’t have had all these problems over all these years." Instead, this country’s voters gave us Harry Truman, who had already negotiated away the rights of Bulgaria, Hungary, Poland, and Rumania, handing them over to the Soviet Union after World II. In further concession to the Soviets, Truman helped cut up Europe to the great distress of all concerned in that part of the world. Had voters elected Thurmond, there would never have been a North Korea with which we have to deal very seriously now that they have nuclear weapons.
But it is none of these arguments which captured the attention of the "thought police." It was the new American taboo of saying anything blacks do not wish to hear. Lott may never have meant, as happily charged in the press, that we would have been better off with a segregationist President, but I wish he had. It is true, and it is time someone says so.
Flippant feminist columnist Kathleen Parker went into hysterics, asking just what kind of "problems" Lott meant. Using silly references to Hitler, she wrote, "Wonder which problems Herr Lott had in mind? That darned black vote? Those integrated public schools? Hip-hop? White flight? Black crime? The blind date that darkens the door of the white family room?" Not bright enough to realize it, she was giving all the correct answers. To think that white parents are not concerned about the racial makeup of their families and passing down inherited traits from generations back, as deeply as Jews are concerned about inter-faith marriage which nearly always results in a non-Jewish household, is to exhibit a profound ignorance of the importance of race in this country and in the world.
Blacks, who are very clever, have discovered a formula which has neutralized every public official in this country. It involves intimidation, threats, retribution, incessant demands, extorting money from corporations, attempting to bankrupt companies in court, and in general making themselves as obnoxious as possible so that no one will say or do anything which might displease a black man or woman. Politicians, who make the laws, have submitted to the black agenda, and we see an increasingly socialistic government as a result. In other words, give up your liberties quietly or be prepared to suffer ignominy. There is no fight left in the white public sector. That is why we saw immediate disavowals and apologies from Trent Lott. Would that Trent Lott cared more for his integrity than his position as Senate leader. If he really believed in the things embodied in the compliment given to a 100-year-old man on his birthday, then Lott would be worth a whole lot more to Mississippi and the rest of us as a simple Senator who just might be representing a majority of white people who have no one to speak for them.
Even those who call themselves conservative were among the Lott detractors, and Armstrong Williams, considered among some as a "leading black conservative," tore into Lott in savage rhetoric. Which brings me to an observation: Some blacks find advantage in masquerading as conservatives, but when it comes to race, they are not conservative with YOUR views. You better bury your own deeply held beliefs and subscribe to their odd racial opinions or have your whole existence become a nightmare. In other words, white men should "shut up." And that is basically what we have learned from the Trent Lott Affair.

(This column may be used for reprint
free of fees and charges.)A TRIBUTE TO THE GOOD PEOPLE OF GEORGIA
By Graham C. Owen, Commander, Sgt. Charlie Dickison Camp 534,
Florida Division December 7, 2002
"TAKE DOWN THE FLAG" GOVERNOR BARNES HAD SAID,
AND JOINING IN THE CHORUS, OTHER POLITICIANS PLED,
TO REMOVE GEORGIA'S OLD FLAG FROM ON ITS POLE,
BUT THE PEOPLE SPOKE "NAY, NOT THAT FLAG FOLD."
THE SCALIWAGS HEEDED NOT THE WORD,
THEY REMOVED THE FLAG, THE PEOPLE WERE NOT HEARD,
THEN CAME ELECTION AND ON THAT DAY,
THE PEOPLE OF GEORGIA FINALLY HAD THEIR SAY.
NOW SITTING AT HOME, THEIR POWER IS GONE,
THEY HAVE LEARNED A LESSON, ONE THAT IS STRONG.
WHENEVER A GOVERNOR OR REPRESENTATIVE STRAYS
SEND THEM HOME FROM OFFICE, TILL THEY MEND THEIR WAYS.
SO IN THE FUTURE, OUR COURSE IS CLEAR.
HOLD TO OUR VALUES AND HERITAGE DEAR.
LET NOT THE TURN-COATS ERASE OUR CAUSE
TURN THEM OUT OF OFFICE, AND CLIP THEIR CLAWS.
The term "Johnny Reb" evokes an image of a white soldier, Anglo-Saxon and Protestant and from an agrarian background. Many Southern soldiers, however, did not fit this mold. A number of ethnic backgrounds were represented during the conflict.
For example, thousands of black Americans
fought as Johnny Rebs. Dr. Lewis Steiner of the U.S. Sanitary Commission
observed that while the Confederate army marched through Maryland during the
1862 Sharpsburg (Antietam) campaign, "over 3,000 negroes had arms,
rifles, muskets, sabers, bowie knives, dirks, etc. And were manifestly an
integral portion of the Southern Confederate Army."
There also were Hispanic Confederates. Col.
Santos Benavides, a former Texas Ranger, city attorney and mayor of Laredo,
Texas, commanded the 33rd Texas Cavalry, while Gen. Refugio Benavides
protected what was known as the Confederacy of the Rio Grande. Recent Irish
Catholic immigrants also chose to fight for the South, as did a few stalwart
Chinese who served nobly in Louisiana.
The largest ethnic group to serve the
Confederacy, however, was made up of first-, second- and third-generation
Jewish lads. Old Jewish families, initially Sephardic and later Ashkenazic,
had settled in the South generations before the war. Jews had lived in
Charleston, S.C., since 1695. By 1800, the largest Jewish community in America
lived in Charleston, where the oldest synagogue in America, K.K. Beth Elohim,
was founded. By 1861, a third of all the Jews in America lived in Louisiana.
More than 10,000 Jews fought for the
Confederacy. As Rabbi Korn of Charleston related, "Nowhere else in
America — certainly not in the Antebellum North — had Jews been accorded
such an opportunity to be complete equals as in the old South." Gen.
Robert E. Lee allowed his Jewish soldiers to observe all holy days, while Gens.
Ulysses S. Grant and William T. Sherman issued anti-Jewish orders.
Many young Jews served in the ranks. There were
a number of Jewish officers who were part and parcel of Southern society. They
had spent their formative years in the South defensive about slavery and
hostile about what they perceived as Northern aggression and condescension
toward the South. Some of the more notable among the officer corps included
Abraham Myers, a West Point graduate and a classmate of Lee's in the class of
1832. Myers served as quartermaster general and, before the war, fought the
Indians in Florida. The city of Fort Myers was named after him.
Another Jewish officer, Maj. Adolph Proskauer of
Mobile, Ala., was wounded several times. One of his subordinate officers
wrote, "I can see him now as he nobly carried himself at Gettysburg,
standing coolly and calmly with a cigar in his mouth at the head of the 12th
Alabama amid a perfect rain of bullets, shot, and shell. He was the
personification of intrepid gallantry and imperturbable courage."
In North Carolina, the six Cohen brothers fought
in the 40th Infantry. The first Confederate Jew killed in the war was Albert
Lurie Moses of Charlotte, N.C. All-Jewish companies reported to the fray from
Macon and Savannah in Georgia. In Louisiana, three Jews reached the rank of
colonel: S.M. Hymans, Edwin Kunsheedt and Ira Moses.
Many Southern Jews became world-renowned during
this period. Moses Jacob Ezekiel from Richmond fought at New Market with his
fellow cadets from the Virginia Military Institute and became a noted
sculptor. His mother, Catherine Ezekiel, said she would not tolerate a son who
declined to fight for the Confederacy.
He wrote in his memoirs, "We were not
fighting for the perpetuation of slavery, but for the principle of States
Rights and Free Trade, and in defense of our homes which were being ruthlessly
invaded." In tribute to Ezekiel, it was written, "The eye that saw
is closed, the hand that executed is still, the soldier lad who fought so well
was knighted and lauded in foreign land, but dying, his last request was that
he might rest among his old comrades in Arlington Cemetery."
The most famous Southern Jew of the era was
Judah Benjamin. He was the first Jewish U.S. senator and declined a seat on
the Supreme Court and an offer to be ambassador to Spain. Educated in law at
Yale, he was at one time or another during the war the Confederacy's attorney
general, secretary of war and secretary of state. After the war, he settled in
England, where he became a lawyer and wrote a seminal legal text.
Simon Baruch, a Prussian immigrant, settled in
Camden, S.C. He received his degree from the Medical College of Virginia and
entered the conflict as a physician in the 3rd South Carolina Battalion, where
he joined the fighting before the Battle of Second Manassas. He eventually
became surgeon general of the Confederacy.
While he was away during the war, his fiancee,
Isabelle Wolfe, painted his portrait in the family home in South Carolina. It
was at this time that Sherman began his March to the Sea. His raiders set the
Wolfe house afire, and as she rescued the portrait, a Yankee ripped it with
his bayonet and slapped her. Witnessing this, a Union officer gave the
attacker a beating with his sword.
From this, a romance began to blossom —
quickly squelched by the young woman's father, who remarked: "Marriage to
a gentile is bad enough, but marriage to a Yankee, never, ever, it is out of
the question." Isabelle Wolfe eventually married Baruch. After the war,
they moved to New York City, where he set up what became a prominent medical
practice on West 57th Street.
Mrs. Baruch became a member of the United
Daughters of the Confederacy, and the couple raised their children with
pro-Southern views. If a band struck up "Dixie," Dr. Baruch would
jump up and give the Rebel yell, much to the chagrin of the family. A man of
usual reserve and dignity, Dr. Baruch nevertheless would let loose with the
piercing yell even in the Metropolitan Opera House.
Their son Bernard became the most successful
financier of his time and one of the best-known American Jews of the 20th
century. Bernard Baruch was an adviser to presidents from World War I to World
War II and became a confidant of President Franklin D. Roosevelt.
Today, little remains of the Jewish Confederate
South. With the mass migrations from Russia and Eastern Europe, new immigrants
knew little if anything of the struggle that had ensued during the preceding
half-century. Confederate Southern Jewry eventually disappeared.

War on terrorism a threat to liberty?
http://www.washtimes.com/commentary/20020321-90276020.htm
Paul Craig Roberts
The war on terror is creating media attention and fund-raising opportunities for conservative organizations. It is also creating confusion of thought among conservatives and, thereby, opportunities for more centralized government power and a police state.
Too many Americans are coming to accept that a successful war on terror requires a police state in whole or part.
For example, the Model State Emergency Health Powers Act would give state governors the power to order people from their homes and force them into quarantines, separate parents from children, impose price controls and rationing, and confiscate guns and other property.
Supposedly, this is to protect us from germ warfare, but herding people into confined spaces is the best way to spread disease.
The Emergency Health Powers Act is sponsored by the federal agency, Centers for Disease Control. According to Phyllis Schlafly, the bill, conveying dictatorial powers upon governors, is already moving through state legislatures.
We are in far more danger from the belief that the ends justify the means than we are from terrorists.
The Mythical Lincoln
by Thomas J. DiLorenzo
Every February 12 Americans think they are celebrating Lincoln’s birthday. But what they are really celebrating is the birth of the Leviathan state that Lincoln, more than anyone else, is responsible for bringing about. No wonder federal politicos have made his birth date a national holiday, engraved his face is on Mount Rushmore, built a Venus-like statue of him in Washington, D.C., and put his mugshot on the five dollar bill.
More than 130 years of government propaganda has hidden this fact from the American people by creating a Mythical Lincoln that never existed. Take, for instance, the fact that everyone supposedly knows – that Lincoln was an abolitionist. This would be a surprise to the preeminent Lincoln scholar, Pulitzer prize-winning Lincoln biographer David Donald, who in his 1961 book, Lincoln Reconsidered, wrote that "Lincoln was not an abolitionist." And he wasn’t. He was glad to accept on behalf of the Republican Party any votes from abolitionists, but real abolitionists despised him. William Lloyd Garrison, the most prominent of all abolitionists, concluded that Lincoln "had not a drop of anti-slavery blood in his veins."
Garrison knew Lincoln well. He knew that Lincoln stated over and over again for his entire adult life that he did not believe in social or political equality of the races, he opposed inter-racial marriage, supported the Illinois constitution’s prohibition of immigration of blacks into the state, once defended in court a slaveowner seeking to retrieve his runaway slaves but never defended a runaway, and that he was a lifelong advocate of colonization – of sending every last black person in the U.S. to Africa, Haiti, or central America – anywhere but in the U.S.
Thomas J. DiLorenzo [send him mail] is professor of economics at Loyola College in Maryland. His latest book is The Real Lincoln: A New Look at Abraham Lincoln, His Agenda, and an Unnecessary War (Forum/Random House, March 2002).

We really cannot blame Americans too much for holding on to their myths, even though they can only achieve pride by putting us down. If Americans had to take a look at the real Constitution, the real Declaration of Independence, the real Abraham Lincoln, the real war for Union and emancipation, which was neither noble nor necessary, their whole national morale would start to fall apart. That is why the anti-South people have been talking less about slavery lately and starting to dismiss the Confederacy with nasty and summary charges of "treason," as if the right to secede was not what the war was all about. What else have Americans got to sustain their society which has pretensions to world domination while disintegrating from within. The Melting Pot? – only a half-truth at best. Global Democracy? – a pernicious abstraction.
Still, it is true that until a very few years ago, the Confederacy was an accepted and honored part of the American national heritage. The current jihad against our forebears indicates a radical forward step in the movement toward government suppression of free thought and expression.Dr. Clyde Wilson

How the Justice Department and FBI’s reliance on the Southern Poverty Law Center is bringing about a new era of McCarthyism
By John C. Hall , Jr. C.P.A.
GrldOhara@aol.com
Recently in the press there have been quite a few references to what are being called "Domestic Hate Groups." In light of September 11th terrorist attacks on our country many Americans are willing to get behind the "War on Terrorism" by taking as the Gospel information coming out from an organization called the Southern Poverty Law Center or "SPLC". I for one am all for getting the bad guys who have attacked our country but based on my personal experiences, the American public should temper their current Patriotism with a little skepticism when it comes to relying on the SPLC. The problem is that the Justice Department and FBI are relying on the SPLC to help weed out the bad people in these groups.
The SPLC is a Civil Rights organization founded in 1971 by Morris Dees and Joe Levin. Based in Montgomery Alabama this organization’s founders were actively involved in the Civil Rights movement of the early 1960’s. Its first President was Julian Bond who is now Chairman of the National Association for the Advancement of Colored People of "NAACP."
While originally active in the areas of civil rights, as time has passed the need for the SPLC’s kind of activism in regards to Civil Rights has faded with the successful implementation of equal rights across the American Continent over the past 40 years. As with any organization that has outlived its original purpose, the SPLC in recent years has tried to find a way to justify its continuance as an effective organization. What the organization has tried to do is position itself as a kind of watchdog for America. It has actively worked with the Justice department and the FBI (A holdover from the Clinton era) in an effort to keep track of these so called "Domestic Hate Groups."
The problem with what has happened with the SPLC and its recent efforts is that it has decided to include a new category in what it calls "Domestic Hate Groups." This new category is called the Neo-Confederates. Beginning with the SPLC’s Summer quarter of 2000 magazine known as the "Intelligence Project" the SPLC has sought to deem all Southern Heritage Groups a part of the Hate Groups that exist in America. By doing this the SPLC is not really helping America identify those who are a real threat to America but merely trying to silence what it perceives as an ideological threat to its existence.
Approximately 10 years ago I became involved in what I like to call the Southern Heritage Movement. This Movement arose because of the NAACP’s efforts to remove the Confederate Battle Flag from all public properties which was begun by a 1991 resolution passed at the NAACP’s National Convention.
One of several organizations I joined as a part of the Southern Heritage Movement and that I am still a member of is called the League of the South or "LOS". This organization is merely a Southern Cultural organization which believes in the principles for which the Southern States Seceded from the Union which are individual States Rights and limited federal Government. The LOS has been prominently mentioned in the recent press reports regarding "Domestic Hate Groups"
As my involvement in the Southern Heritage Movement has grown over the years, I have had several events happened that made me a personal target of the SPLC, Justice Department and the FBI. The first of these was in Atlanta where I live in the Suburbs.
After the 1996 Olympic bombing at Centennial Park I was paid a visit by two FBI agents at my home. A male and female agent came to my house each with weapons attached to question me about a letter I had written the Wall Street Journal regarding the Olympic Torch Run. I had written the letter which basically said "Wait until the Torch gets to Atlanta and see what we have for the Olympics." As many Southerners know, the 1996 Olympics did not allow any Confederate Symbols or Culture including the Georgia State Flag be a part of the Games.
The FBI wanted to know what I meant in my letter and I must say I was shocked that a simple letter would cause such a reaction. I proceeded to inform the FBI that I helped coordinate an effort across the South and in Georgia to have Southerners present Confederate Flags in communities where the Torch was passing through. Many of those who participated dressed in Confederate Uniforms and Bell Dresses. The idea was to put a little South into the Games that was sorely missing. I went on to bring out a large set of files showing my communications and plans along the Torch’s path. The FBI agents left knowing they didn’t have the Centennial Park Bomber.
The second event that occurred was when the FBI again visited me at my place of business in the Summer of 2000. Once again two agents from the FBI showed up. This time they wanted to know why I was organizing a protest at the NAACP’s National Convention. They had gotten a call from the Justice Department which had been contacted by the Baltimore Police department about a peaceful protest being planned.
My answer to them was that for me personally I had grown tired of the NAACP using Tax Free money to wreak havoc on Southern States such as South Carolina, Mississippi and Georgia; each of which displayed a Confederate flag in either its State flag or on top of its Capital. I also told them I was proud of my GGGrandfather Captain Stephan Alphestus Corker of the Third Georgia and him leading the 3rd Georgia’s charge at Gettysburg! After hearing my answer, snooping around my office and asking me if I owned any weapons; they left. Later at the NAACP convention we went on to having a peaceful protest that included meaningful dialogue between adversaries.
Soon after the NAACP convention the SPLC came out with their Summer 2000 "Intelligence Report" which had the title "Rebels with a Cause - A Special Report on the Neo-Confederate Movement." Imagine my surprise when I found out that my picture was on the front cover of the magazine. The picture shown was of myself and several others on the steps of the South Carolina Capital at the January of 2000 rally of 10,000 Confederates rallying to keep the Battle Flag on top of the Dome. I was dressed in my Confederate Uniform and the angle of the picture captured me in a pose that fit their title of Neo-Confederates. I had my arm raised while waving a small a Georgia Flag and it was obvious the SPLC was trying to make me look like a Neo-Nazi. Most certainly they were trying to demonize those who support Southern Heritage.
Almost the entire magazine dealt with the threat of the "Neo-Confederates". As I flipped through the publication I saw my picture again in the contents page. But the real shocker was when I turned to the lead article and standing all alone was another picture of me in my uniform which underneath stated "A Neo-Confederate movement, increasingly rife with white supremacists and racist ideology, is growing across America." In a nutshell I had become the SPLC’s poster boy for the "Neo-Confederate movement!"
The reader must know that I am a Christian married father of two home-schooled children who owns his own business. I just happen to respect the struggle of my ancestors in the War Between the States and wish to honor their memory. I also believe in the Constitution and Free Speech.
I decided at this point that I had had enough and subsequently tried to find out what the FBI was up to. I had several questions I wanted answered. Were they bugging my phone? Staking out my house? Following my Children? Sharing personal information with the SPLC? The only way I knew to try and get these answers was to file a request under the Freedom of Information Act. This act is supposed to guarantee Americans that their Government is not sneaking around and harassing innocent citizens without cause.
After three attempts to get a response from the FBI and getting my Congressman Johnny Isakson involved, the FBI stated that they would not release any information regarding my file. An exemption under the FOI Act was mentioned in their response and the reason that they gave was that they had an ongoing investigation which would be jeopardized by releasing information. Apparently for the average citizen there is no real Freedom of Information when it comes to finding out what the FBI is up to. The government can just make exclusions and keep their activities a secret.
So be careful America. It looks like we are in a new era of McCarthyism. The SPLC looks a lot like the good old Senator from Wisconsin with the Justice Department and FBI going right along with it. . Like Gold the SPLC once could find a lot of nuggets regarding the Civil Rights Movement which made it a somewhat legitimate organization but now they can’t find any real veins. They just keep finding fool’s gold and the Justice Department and the FBI are buying it. Who knows if the Justice Department and the FBI hadn’t been so busy relying on the SPLC, investigating an Irish-American citizen born in the South with over 200 years of ancestry in the USA, then maybe September 11th could have been prevented and we wouldn’t have had approximately 4,000 Americans murdered by real terrorists.

Appeals Court Rules On Second Amendment
BELLEVUE, WA - In a stunning decision, the 5th Circuit Court of Appeals

At the U.N. conference, some African leaders said that since slaves were forcibly taken from Africa, they deserve compensation for this loss. Among many problems with this argument are two that are particularly relevant. First, very few slaves were kidnapped by European slave traders. The vast majority were sold into slavery by African leaders of the time.
Second, these African leaders were paid very well for the slaves they sold. So to compensate them a second time for their loss is like paying compensation to a thief for robbing you.
A survey of slaves taken by one Sigismund Koelle in Sierra Leone in the 1850s. According to his research, which may not be typical for the whole slavery era, 34 percent of slaves had been taken prisoner in war, 30 percent had been kidnapped by Africans, 11 percent suffered enslavement as punishment for a crime, 7 percent had been sold to pay debts, and another 7 percent had been sold by relatives or friends. The rest fell into multiple categories.
Finally, it is worth noting that the U.S., against which reparations demands have been strongest, only got about 4 percent of the slaves taken from Africa. According to a careful calculation by historian P.D. Curtin, between 1500 and 1870, 399,000 slaves were brought to the U.S. Almost 10 times this number went to the Caribbean and about the same to Brazil.
Val Finnell wrote
`Conservatives react to these things [liberal shenanigans] with horror and
cite the law, objectivity, fairness, and the "facts." Guess what? The
liberal Democrats and their political henchmen don't care about such
antiquated notions....
`Because theological conservatives have the correct worldview (even though
they do not consistently apply it), they tend to be honest and uphold the
rule of law. Not only that, they tend to abhor confrontation and thus
embrace compromise to make the liberals go away. On the other hand, the
liberals have no barriers to lying because in their worldview the end
justifies the means. They embrace confrontation and will do whatever is
necessary to achieve their goals whether it is legal/moral or not.
`Senator H. L. Richardson (retired) of California summarizes this dilemma:
`"Traditional Americans dislike conflict and withdraw from it as a matter
of habit and training. On the other hand, the humanist looks upon
confrontation as a necessity, a positive ingredient in advancing humanistic
programs. They expect confrontation, plan for it and anticipate the
predictable, negative reaction from their opposition, often using the
reaction to further promote their cause. Conflict, therefore, is expected,
welcomed, analyzed and then used to advance their goals. Momentum is
obviously on the side of the aggressors since they have the tactical
advantage of initiating the attack. Once the conflict is engaged, the
Leftists anticipate the opposition's response and judge their effectiveness
accordingly. The issue is pursued until the Conservative resistance becomes
formidable and an overall negative result could occur. At that time, a
dialectic step, a backward move, is in order. A strategic retreat, giving
up some ground.6"
`Senator Richardson goes on to say that this dialectical step backwards
leads to a compromise solution with the conservatives. The conservatives
agree in order to placate the Leftists. The liberals then pick up where
they left off with the next legislative or judicial initiative starting the
cycle all over again. This is why conservatives must always lose.
Conservatives are caught in a vicious cycle of "attack-compromise-retreat"
that steadily erodes our civil liberties.
`If conservatives want to win, they must play hardball and move from
defense to offense. They must be willing to advance their agenda to create
their own dialectical moves in the political process. They must abandon the
"Democrat Lite" philosophy for a fully-orbed conservative program....
`When the liberal Democrats (and liberal Republicans) slash and burn,
conservatives must not only put out the fires, but initiate their own
conflagrations inside the enemy camp. Politics is like war without the
guns. It's dirty. It's cruel. And someone is going to get hurt. It's high
time for conservatives to start creating some casualties in the liberal
camp. If conservatives don't change their paradigm, it will only be a
matter of time before Christian principles are totally defeated in the
United States.'

- The claims were filed with the Department of Education, office of Civil
- Rights alleging discrimination based on race and national origin.
- Investigation and arbitration has been requested. Claims were also filed
- with the Department of Justice, Equal Opportunity Section alleging
- discrimination based on religion.
- Constitutional claims and civil rights claims will be filed in Federal court

Gentleman,
This move will show the naacp as the hate mongers they really are, and the
people of Mississippi will surely stand up to their tactics now more than ever.
Actually, the boycott has increased revenue in S. Carolina.
NAACP officials have indicated that the civil
rights organization may be coming closer to a South Carolina-styled
economic boycott in Mississippi.
This after a mid-April state referendum in which citizens voted 2-1 to officially
adopt the state's flag which bears the Confederate Saint Andrews Cross.
The oath which all commanding officers of UN deployments must take:
"I solemnly affirm to exercise in all loyalty, discretion and conscience the functions entrusted to me as a member of the international service of the United Nations, to discharge those functions and regulate my conduct with the interest of the United Nations only in view, and not to seek or accept instructions in respect to the performance of my duties from any government or other authority external to the organization."
SCV license plates have been under attack on several fronts in Virginia
during the last few weeks. The Virginia Division was given less than 24
hours to celebrate their Federal District Court victory when Attorney
General Mark Earley, a Republican candidate for Governor, decided to
appeal the decision to the 4th Circuit Court of Appeals. Many papers in
Virginia speculated on his reasoning for such a quick appeal and most
centered on his pandering for black votes in his future election. Most
legal pundits felt that an appeal would be both costly and ineffective
since the lst Amendment will not be overcome by Earley's arguments that
the state of Virginia has the right as a government to control the
contents of speech on vanity license plates. Earley has made it known
which side of the issue he comes down on. Many SCV, reenactors and other
Virginians sick of this political correctness have turned to his
adversary in the Governor's race, John Hager, who has endorsed both
Confederate History Month and SCV license plates during his campaign.
People are lining up to be Hager Delegates to the June Republican
Convention in Richmond.
Probably sensing the futility of Earley's appeal, Donald McEachin,
a black Richmond area member of the House of Delegates, sponsored a bill
which would repeal the SCV license plates entirely. During a televised
interview, McEachin generously said he would withdraw his bill if the
SCV would put a different logo on their tags. The Virginia Division
lobbied heavily with legislators to defeat this measure and when it came
up in front of the House Transportation Committee, McEachin withdrew the
bill sensing that he did not have enough votes to get it through.
The Rutherford Institute has advised the Virginia Division to
proceed with the applications for SCV license plates.

A Judge in Maryland just ruled that the [U.S.]
government's "continual reference to the
Confederate flag as a symbol of racial intolerance and divisiveness
clearly demonstrates that [those in the government] are choosing, and
advancing, the viewpoint of those offended by the flag over the
viewpoint of those proud of the flag." A Southern Victory!
Report from the 6th Circuit Court of Appeals
The Southern heritage battle was fought in the halls of federal court today,
as the 6th Circuit heard oral arguments on the case of Castorina vs Madison
County School Board. It was a proud day for us, and our ancestors, I
believe. Chad Sayre, a Ky SCV member, presented the oral arguments to the
3-judge panel this morning. We have worked for 3 years to get to this point,
and this case is now the only Southern heritage case that is well along in
the legal system.
Trying to read the tea leaves of what the judges' questions mean is a
guessing game, so understand that most of the following are my impressions,
but who knows what will be ruled.
Our case boils down to three constitutional complaints; due process (the
parents and students were never allowed to take their grievance before the
school council or school board), freedom of speech, and equal protection
(students with Malcom X and other shirts that could be construed as racially
based were not disciplined). Primarily we are citing a case known as Tinker,
in which the 1st amendment and equal protection rights of students were
upheld. The Tinker decision recognizes that schools must maintain order and
fulfill their mission of education, which sometimes may involve curbing
first amendment rights, but those curbs must be applied evenly.
The school systems' case is based in two areas. They claim, under Tinker,
that there was an imminent potential disruption in the school due to the
t-shirts, and thus they acted appropriately. They also claim (and the
district court judge ruled in his summary judgment) that the t-shirts'
images are not protected speech. They claim that the t-shirts aren't
protected speech because they "don't carry a message". This seems to me to
be a terrible argument, because the school says that the Confederate flag is
racist and that is why they want them removed. How can they be construed as
racist if they "don't carry a message"? Even Judge Kennedy, whose questions
usually seemed to be "against" us, pointed out that the students came back
to school after their suspension wearing the shirts again specifically as a
protest. "How could that not be a message?" she asked.
Chief Judge Merritt seemed to be very sympathetic to our "equal protection"
argument. He came back to it several times, even tossing it out as a
"softball" question for our side to respond to. He explicitly pointed out
that Tinker required a neutral application of dress code rules, and that
allowing Malcom X shirts while not allowing Hank Williams shirts with flags
could not be considered neutral. "What's good for the goose under the first
amendment, must be good for the gander" he said at one point. It's
interesting to me that we've been making this argument repeatedly with
school and other officials and it's often considered a joke by the
powers-that-be. They don't seem to see the hypocrisy of banning Southern
symbols while allowing other cultural and racial symbols. It was very
refreshing to see a judge who is in a position to give our position some
"teeth" seeming to take the same side.
The judges, especially Judge Merritt, were also very interested in our first
amendment argument. Frankly, this is an argument which we have not been
prevailing on in other cases, but Judge Merritt came back to it over and
over. Judge Merritt also seemed quite perturbed that this case had been
decided in a summary judgment. He seemed to want to use that against the
opposition, by saying that he had to accept the testimony of the students as
truth, since there had only been deposition and no trial. Using that as a
basis, Judge Merritt posed a series of questions to the school board's
attorney which ended with the judge saying "it seems to me that you violated
their first amendment rights, isn't that so?". The attorney gave a vaguely
positive answer, so the judge repeated the question more directly, to which
the attorney replied, "Yes...in a general sense". To me, this was quite a
"Perry Mason" moment. We had the opposing attorney admitting that the school
system violated the student's rights!!
The judges also asked our attorney what remedy we would like, seeming to
indicate a preference for remanding the case back to the district court for
a trial. Our response was that we wanted that "at a minimum".
Interestingly, the "due process" argument wasn't touched on very much,
though it seemed to me that this was one of our strongest. Does that mean
that the judges didn't care about this aspect, or perhaps they bought our
argument in the briefs without needing further questions? Or perhaps (my
theory) the judges saw this as an interesting "equal protection" case, and
an interesting revisit to the first amendment hair-splitting of the Tinker
decision. Compared to those two, maybe the obvious lack of due process isn't
as "sexy".
Overall, the feeling was very positive for our side. I realize that the
judges could have been playing "devil's advocate", but at several points
they didn't ask questions but made statements of their opinion ("I think
that violates equal protection", etc.). Guessing what judges might
